DAMIEN LARACY
Damien specialises in commercial litigation, shipping and arbitration. His day to day practice involves international trade and sale of goods issues, complex cross border debt recovery, shipping disputes (cargo claims, charterparty claims), shareholders disputes, and enforcement of Judgments and Awards in the PRC and in Hong Kong.
He also has significant experience with ship mortgage enforcement work, and with disputes concerning personal injuries and fatalities (including aviation fatalities). Damien’s arbitration practice regularly requires the firm to advise in relation to drafting and construction of arbitration references, and enforcement of Awards in the PRC and elsewhere.
Damien is currently acting as an arbitrator in an international arbitration pursuant to the LMAA Rules (2006).
NICK GALL
Nick’s principle practice areas include insolvency, acting for many of Hong Kong’s leading accountancy practitioners in their capacity as Liquidators and Receivers, and also for publicly listed companies and the Hong Kong Government. This work often requires document intensive cross-border applications, urgent injunctive relief, the examination of senior executives/bank officers and recovery and enforcement proceedings generally.
Nick is also a well respected employment lawyer, and acts for senior executives and major corporations in high profile employment disputes. This has included the enforcement of restrictive covenants through peremptory means, the relocation of large groups of employers, and negotiation of exit/entry packages. In 2007 alone, Nick advised on employment contracts totaling in excess of HK$600 million.
Nick is also regularly instructed to act in respect of investigations and charges arising out of the Independent Commission Against Corruption and other regulatory bodies in Hong Kong.
LEWIS MAN
Lewis’s practice has a strong emphasis on contentious insolvency, cross-border litigation, fraud investigations and personal injuries.
Recent work includes acting for an international group of companies in fraud and breach of directors’ fiduciary duties claims worth in excess of HK$1 billion; acting for liquidators, and creditors in various corporate restructuring, insolvency and asset recovery matters; advising US and UK companies on regulatory and insurance issues; advising on an indigenous land dispute and acting for individual plaintiffs and defendant multinational corporations in personal injury matters.
Lewis sits on the Law Society’s Ad Hoc Committee for Insurance, is a member of the HKICPA’s Restructuring and Insolvency Faculty and has been a contributing author of the Hong Kong White Book commentary.
RANDALL ARTHUR
Randall has extensive experience in commercial dispute work with a particular emphasis on corporate commercial litigation, contentious insolvency, fraud and asset tracing, employment disputes, shareholder disputes and banking and finance litigation generally.
Randall is a member of the HKICPA Restructuring and Insolvency Faculty and the Financial, Legal and Tax Committee of the Australian Chamber of Commerce. He also regularly speaks at events organised by groups such as Lexis Nexis and INSOL International.
JEFF LANE
Jeff has nearly twenty years of experience of resolving commercial disputes of all kinds in Hong Kong including banking, insolvency, employment, regulatory, professional negligence, telecommunications, administrative law and fraud and tracing matters. In this latter specialization, Jeff was recently appointed as the sole Hong Kong representative of FraudNet, an international network of law firms that specialise in fraud and white collar litigation and investigation.
He has also represented clients in securities and regulatory investigations conducted by the SFC, Hong Kong Stock Exchange, CCB and the ICAC. Jeff is a contributing author to the Hong Kong Civil Procedure, and sits on a number of Committees and Working Parties with the Law Society of Hong Kong.
